The courts do not like competition agreements because they violate the rights of the doctors employed and the rights of clients to freely choose the tradesman, the service professional. However, the courts will intervene and apply them if there is a proper balance between the risk to an outgoing employee`s employer and that employee`s ability to work elsewhere. When an employee uses his own vehicle, the employment contract should describe it and provide a detailed description of the compensation. In this case, most firms use the IRS annual reimbursement rate for mileage, but some states offer another published rate that may be lower. As part of the Comprehensive and Extended Partnership Agreement (CEPA), the EU and the Republic of Armenia have agreed to 13 harmonised certificates for exports from EU countries to Armenia. The decision 2/2004 of the Joint Veterinary Committee for Agricultural Trade of 9 December 2004 amending Schedules 1, 2, 3, 4, 5, 6 and 11 of Schedule 11 of the agreement is also included in most employment contracts. Some practices offer sick days, personal days, days off and time for continuing education, and call them specifically in the contract. Others use a paid time-off (PTO) system where time is not specified. Still others do not note time in the agreement and use a staff manual to determine how it is managed. The published rate that is used should be indicated, as well as the mileage transmission settings and payment method.
For example: “The employee must provide a vehicle from which he can practice. The employer provides, for its own costs, veterinary equipment and supplies that the employer deems necessary (excluding vehicle cabinets and vehicles) necessary for veterinary practice. At the end of this contract, the worker must return all these devices and deliveries within 24 hours in good condition. The employer reimburses the worker for the mileage for professional purposes, at the rate set by the Internal Revenue Service (IRS). The employee must keep a mileage report in accordance with IRS rules and pass it on to the employer at the end of each month. Miles are refunded monthly and no later than the 15th of the month following the one deposited. Key elements of an employment contract include the length or duration of the contract, compensation, customs duties and work plan, emergency service requirements, leave or other periods away from work, benefits, a non-competition clause and termination conditions.
