Given that TROA is the result of negotiations and an agreement between at least five mandatory signatory parties and must be promulgated as a federal regulation, this rule, referring to the signed agreement, contains exactly the same thing as it was negotiated. If there`s been a lot of arguing about the river water, what`s it going to stop now? Comment: Parties to TRA agreed that the water saved would flow into the river and that 31 percent of this diverted river would be available for TCID, redirect and use advantageously. TROA does not include this term in TRA. The pact also provides for improved conditions in the Cui-ui watershed and Lahontan Cutthroat trout fish populations in Pyramid Lake. For the Pyramid Tribe, the Truckee River below Derby Dam and the spill to Pyramid Lake under TROA will increase slightly. With increased flow and the ability to manage water from the Truckee River, TROA: helps improve the lower quality of river water; slightly improve the height of Pyramid Lake; Improve the shoreline Helping to stabilize the lower river; Improved recreation on Pyramid Lake; Improved spawning opportunities for cui-ui and LCT; and improve river habitat for Pyramid Lake fish. In addition, the exercise of agricultural rights and IM on the water of the Truckee River will always be satisfied under the Derby Dam, including that of the pyramidal tribe. For the Reno-Sparks Indian Colony, TROA has no impact on the exercise of water rights on the Truckee River. The Fallon Paiute Shoshone tribe will receive a full water supply at the same frequency as currently. TROA will not have an impact on the flow of the Carson River or the resources of the Washoe Tribe. This rule is not a major federal measure that seriously affects the quality of the human environment.
The final TBEI/EIR concluded that the implementation of the TROA would not significantly affect the quality of the human environment and that the implementation of the TROA would not have inevitable negative effects. No mitigation action is identified or necessary. The exchange and storage agreements, which are an integral part of TROA, could improve the long-term safety of the drought water supply for meadow trucks and improve flow conditions for pyramid fish and aquatic species in general.
